This page explains the privacy policy for the iSEV and how we will use and protect any information about you that you give us when you visit this website. This privacy statement only covers this website and it does not cover any sites that you can link to from this site so you should always be aware when you are moving to another site and read the privacy statement on that site.

This privacy policy is not intended to and does not create any contractual or other legal rights in or on behalf of any party.

Public Areas

When using the public areas of this site you are not required to provide us with any personal information and we do not monitor or collect any personally identifiable information from you on your use of the public portions of this site. We may track the number of users who visit areas of the site, but this tracking will not identify you.

Personal Information

From time to time we may create registration forms which will ask you to voluntarily provide us with certain personally identifiable data, such as your name, address, telephone number and e-mail address. This information will only be used in respect of the event or information service to which the particular form relates. We will not sell or transfer any information that you supply to any third party. The information which we collect will be handled in accordance with the Data Protection (Jersey) Law 2005, the Data Protection (Bailiwick of Guernsey) Law, 2001, the Data Protection Act, 1998 (UK) and the Data Protection Act of 2002 (Luxembourg) (the 'Data Protection Laws').

Use of your contact details

By using the contact details collected at registration we may periodically send you information about the iSEV. If you wish to be removed from any iSEV data list at any time after registration please e-mail enquiries@isev.co.uk with the word 'Unsubscribe' in the subject line. Upon such a request, we will remove you (and all your personal information) from our database. This may however affect our ability to offer you some of our services.

Disclosure of information to Third Parties

We will not pass your details to any external organisation or third party. The iSEV reserves the right to access and disclose individually identifiable information to comply with applicable laws and lawful government requests, to operate its systems or to protect itself or its users. Security.

We have strict security and confidentiality procedures covering the storage and disclosure of your information in order to safeguard it, prevent unauthorised access and to comply with the Data Protection Laws and the Electronic Communications (Jersey) Law 2000. Whilst we do our best to safeguard your personal information, we cannot ensure or warrant the security of any information that you transmit to us.

Cookies/IP addresses

Cookies are pieces of information that your web browser transfers to your computer's hard drive for record keeping purposes. Cookies can make the web more useful by storing information about your preferences on a particular site, thus enabling web site owners to provide more useful features for their users. The technology used in the acampaign.co.uk web site does not currently use cookies, but we reserve the right to introduce their use without notice. Most browsers are initially set to accept cookies, but if you prefer, you can set your browser to refuse cookies. However, if you choose to do so you might impair your ability to use certain site functionality.

The iSEV does not currently log user IP addresses (the location of your computer on the internet) but we reserve the right to for systems administration and trouble-shooting purposes. We do not log IP addresses to track a user's session, nor do we link IP addresses to anything personally identifiable. Your browser will also inform us of the type of computer or operating system being used by you.

Access to your information and contacting iSEV

You have a right to access your information to check whether it is accurate and up to date. Should you wish to access or amend information held about you, or if you have any other queries on iSEV' privacy policy or site security please email support@isev.co.uk.

Monitoring telephone calls and e-mails to iSEV offices

Telephone calls using the telephone numbers provided on this web site and all iSEV extensions and e-mail correspondence with the iSEV via generic or individual employees e-mail addresses may be recorded or monitored. By using such communication methods you are consenting to the recording or monitoring of the same.

Changes to this privacy policy

If this privacy policy changes in any way, an updated version of it will be placed on this page. Regularly reviewing this page ensures that you are always aware of what information is collected by iSEV, how it is used and under what circumstances, if any, it will be shared with other parties. (Clearly should the policy change, information already collected will remain subject to the terms and conditions that applied at the time of collection).

Anti-Spam Policy

aCampaign does not tolerate spam. If we identify a client's account is being used for spam we will terminate their accounts. If you suspect that any of our client's is spamming, Please contact us at abuse@isev.co.uk if you suspect that any of our client's are spamming.

ISPs and Blacklist administrators can also contact us at abuse@isev.co.uk. If you do receive unwanted or unsolicited email from a aCampaign client, please click the unsubscribe link in the footer of the email.

The Policy

In addition to agreeing with our Terms and Conditions, allowable use of aCampaign includes the sending of recipient solicited graphical newsletters, brochures, promotions, invitations, press releases, product launches and other email campaigns that keep registered customers or members informed.

aCampaign does not allow Unsolicited Commercial Email (UCE) or Unsolicited Bulk Email (UBE - also known as spam). If the recipient has not verifiably granted deliberate permission to receive the email, it will be classified as UCE or UBE. Verifiably granted deliberate permission is (1) written or email proof that the recipient has asked to receive the mailing; (2) electronic proof such as a time/date stamp and originating IP address demonstrating that the recipient did agree to receive such email.

So to clarify, this means you can send to anyone who has opted in to your list via your website, offline or via a co-registration site. You can send on behalf of your customers, if their list are opted in via their website, offline or via a co-registration site.

And to clarify, what is NOT allowed:

  • emails harvested from websites
  • lists purchased from a 3rd party
  • rented list from a 3rd party
  • lists that belong to another organization (like a chamber of commerce or a club)
  • any unsolicited list even if it is a press release to reporters, prospective customers, prospective voters or potential employers or anyone who has not given you permission to send to them.
  • Sending emails to discussion groups

Policy enforcement - what we do to eliminate spam

aCampaign, users must explicitly certify that their lists consist of 100% certifiable opt-in email addresses. Inability to supply such proof upon request, will result in account termination.

aCampaign reserves the right to monitor all imported lists. This monitoring may include an audit of a client's lists where we at a minimum will request: list source, list age, list collection and confirmation policies.

aCampaign monitor the content of client's emails and flags messages that have content commonly used in unsolicited emails. A match on a send may result in a send being held in queue, until support is able to contact the sender.

aCampaign maintains IP address and date subscribed for every new subscriber that come through subscription processes we manage.

If a client is found to be using aCampaign to send Unsolicited Email, we reserve the right to immediately terminate the client's account without recourse to refund.

An unsubscribe and abuse link is annexed by aCampaign to the footer of every outgoing email. Any efforts to disable this link will result in an immediate suspension of the account.

We invite the greater Internet community to provide us with feedback about our client's use of aCampaign by contacting us at abuse@isev.co.uk.

Complaints Procedure

If we suspect that your account has been used for sending unsolicited bulk emails or spam, your account's sending privileges will be temporarily suspended. To determine whether or not you have sent spam, we will:

  • Review the complaint
  • Review your list for patterns common to harvested lists
  • Review the content of the email in question
  • Review the optin proof for the email address in question

If we determine, that you did indeed spam, then your account will be suspended without recourse to refund.

If we determine, that the complaint was a false-positive (someone who subscribed, but has forgotten that they had subscribed), then we will liaise with both you and the complainant for proper resolution. Upon proper resolution, sending privileges on your account will be reinstated.

ISP and Blacklist relationships

We share information regarding our policies and practices with Blacklist administrators and ISPs and are genuinely keen to discuss potential improvements to reduce any abuse. If you are an ISP, blacklist or mail administrator and would like to contact us, please email abuse@isev.co.uk

Terms and Conditions

aCampaign, a product of iSEV Ltd, is a web-based software application that offers businesses and website operators a software application for HTML design, email list management and statistical analysis tools. aCampaign does not allow unsolicited commercial emails (UCE). For more details on UCE please see our Anti-Spam Policy. By ticking the check box at the end of the signup form stating 'Accept terms and conditions', you are agreeing to these terms and conditions.

The aCampaign service and support offering.

All Services provided by aCampaign are subject, without limitation, to aCampaign's Privacy Policy and Anti-Spam Policy. iSEV Ltd. may modify the terms of the Agreement and may discontinue or change any aspects of the Services at its sole discretion. Any changes to the application or the terms and conditions become effective upon those changes being made live on the www.acampaign.co.uk website.

The Services are subject to monthly or annual subscription fees. If using the free trial period, iSEV reserves the right to suspend your account once it has ended unless you sign-up for a monthly or annual subscription.

Monthly subscriptions are billed monthly, in advance, according to the pricing schedule selected by you during sign-up. Monthly send credits expire at the end of each month. In the event that monthly subscription fees are changed, your fee will remain at the level at which you signed up.

Pay-as-you-go credits are purchased in advance at the set price for the amount you intend to purchase. These pay-as-you-go credits remain on your account until you have used them. In the event that you purchase pay-as-you-go credits your account will remain open as long as one (1) send credit remains on your account.

If you take a monthly subscription, you are authorizing iSEV Ltd to charge via your chosen billing method, a set amount on a regular basis. The date upon which the charge will be levied is the monthly renewal date of your Subscription. If you take an annual subscription, you are authorizing iSEV Ltd to charge your chosen billing method a set amount on a regular basis. The date upon which the charge will be levied is the annual renewal date of your Subscription. Fees are payable in UK Pounds. If iSEV Ltd is for any reason unable to deduct the monthly or annual payment from your chosen billing method, you will be notified via email and your aCampaign account will be disabled until payment is received.

Refund Policy - Given at least 5 working days notice in writing, iSEV Ltd. may at their discretion make a full or partial refund of unused Credits for the remaining period to the aCampaign Subscription.

Restrictions and Responsibilities

iSEV Ltd. reserves all rights other than those expressly granted in this Agreement, and no licenses are granted except as expressly set forth herein.

You will not contest the validity of iSEV Limited with regard to trademarks or other brand features or content during the term of this Agreement, or after the expiration of this Agreement.

aCampaign may only be used in compliance with the US CAN-SPAM Act and the European Privacy Directive and all other applicable laws. You may not use third party mailing lists to distribute unsolicited email to any third party. You agree to indemnify and hold harmless iSEV Ltd. against any damages, losses, liabilities, settlements, and expenses in connection with any claim or action that arises from an alleged violation of any national or international laws resulting from your illegal use of aCampaign.

iSEV Ltd. reserves the right to monitor the newsletters created by you and your use of aCampaign. iSEV Ltd. also reserves the right to remove any content or immediately suspend use of aCampaign, if it believes that use is: 1) in violation of any national or international laws; 2) constitutes pornography; or 3) is excessively violent or contains harassing content or hate speech; 4) improperly exposes trade secrets or other confidential information of another person; or 5) is otherwise malicious, fraudulent, or may result in retaliation against iSEV Ltd by offended recipients.

aCampaign will automatically append an "unsubscribe" link to all outgoing email, which will allow visitors to remove themselves from your mailing list. iSEV may immediately suspend your aCampaign account if you make any attempt to remove or disable this link.

aCampaign will automatically append a "Powered by aCampaign" footer and link on all outgoing email. iSEV Ltd. may immediately suspend your aCampaign account if you make any attempt to remove or disable this footer and link, unless you have come to a commercial agreement with iSEV Ltd. about the removal of the footer and link.

iSEV Ltd. will not share information you may upload (such as email addresses, names, contact information, or images) to aCampaign. Your customer information will not be shared with any other parties, unless required by law. iSEV Ltd. will not use your customer information for the purpose of sending unsolicited commercial email. iSEV Ltd. may use this information and any technical information about your use of the Services to facilitate your use of aCampaign, or in communications with you.

You will comply with the aCampaign Privacy Policy and the Anti-Spam Policy, which may be modified by iSEV Ltd. from time to time.

Termination

This Agreement will have a term beginning on the payment date of the first monthly or annual subscription. You may terminate this Agreement at any time by following the cancellation instructions available from within the application, or by sending an email to support@isev.co.uk.

iSEV Ltd. may immediately terminate this Agreement and suspend access to aCampaign without refund if you are in violation of any of terms outlined in this agreement.

iSEV Ltd. is not liable for any commercial damage caused as a result of its decision to terminate or suspend your aCampaign account.

iSEV Ltd. reserves the right to delete any account data within 30 days after the date of termination.

Warranty Disclaimer

THE ACAMPAIGN APPLICATION AND ANY RELATED SERVICES ARE PROVIDED 'AS IS' WITH NO WARRANTY, AND ISEV LTD EXPRESSLY DISCLAIMS ANY WARRANTY, EXPRESS OR IMPLIED, REGARDING SUCH SERVICES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.

Each Party agrees to indemnify and hold harmless the other party from and against any losses, claims, liabilities, damages or expenses, including reasonable attorney's fees, directly arising from a material breach of this agreement by the other party.

Each Party agrees to indemnify and hold harmless the other party from and against any losses, claims, liabilities, damages or expenses, including reasonable legal fees, directly arising from a material breach of this agreement by the other party.
